   1. inCars and Finopsys Solutions Private Limited, its affiliates, subsidiaries & associate companies, encompassing and not limited to inCars, as mentioned in this Privacy Policy (hereinafter referred individually and / or collectively to as “inCars“) is/are concerned about the privacy of the Personal Data (as defined further) of the users on inCars Website accessible through various internet enabled smart devices (individually and collectively referred to as “Platform”). This Privacy Policy applies to inCars which includes all its parent companies, affiliates, subsidiaries & associate companies and help you understand how we Process (as defined further) your Personal Data when you visit our Platform and use services or even otherwise visit the Platform.

Hence, by Using the Platform or by using / availing any of services or products offered on the Platform, you hereby give your consent or agreement to inCars required under applicable law for Processing your Personal Data.

The automatic collection of this information allows us to provide a smoother and more responsive experience when you use inCars.

If you use a different account (such as Google or Facebook) to sign in to our Platforms, we receive information such as your name, email address, profile URL and profile picture. This will be explained to you by the third party when you first connect the account with the Platform.
   5. You acknowledge that all Personal Data you provide is voluntary and in compliance with the applicable laws. Should we find any of your Personal Data to be non-compliant with our terms and conditions and Privacy Policy, inCars reserves the right to remove such non-compliant Personal Data from our systems. Depending on the severity of the non-compliance, we may choose to discontinue some or all of the services we provide to you.

This encompasses account creation and maintenance enabling you to access our Platform, save preferences, facilitating car comparisons enabling you to compare different car listings effectively, saved searches, etc. Our primary goal is to ensure that your interactions with inCars are as seamless and tailored to your preferences as possible. We use your Personal Data for purposes of offering essential customer support, address your inquiries and resolve concerns regarding the products or services you seek.
      2. We may leverage your Personal Data to enhance your Platform experience using artificial intelligence or other technology. This involves understanding your preferred choices and features, usage patterns, and other interactions, which, in turn, helps improve our products and services and give you personalized recommendations. It also allows us to personalize content and present special offers tailored to your needs.
      3. We conduct regular Platform performance reviews, diagnose technical issues, benchmarking studies and perform data analysis to continuously enhance your user experience which may require us to use your Personal Data.

In accordance with the guidelines set forth by the Telecom Regulatory Authority of India (TRAI), you hereby grant inCars and its affiliates/partners, or any entities accessing your Personal Data through their association with inCars, the authorization to contact you via telephone, mobile, email, SMS, or other communication methods, whether currently available or in the future. This authorization holds even if your number(s) is/are registered in the National Do Not Call Registry (NDNC).

   3. Promotional or Marketing Use:

   3.    1. Most of your Personal Data is stored electronically, although specific Personal Data may also be maintained in physical form. We might store, collect, utilize, and process your Personal Data within India and/or outside India, subject to adherence with applicable laws. To ensure the security and integrity of your Personal Data, we may collaborate with third-party entities, both within and outside India. These third parties maintain their security protocols, in line with the industry's best practices, to protect your Personal Data effectively.
   2. We will keep your Personal Data as long as it necessary to provide you services on the Platforms or for the purposes for which the Personal Data was obtained. Therefore, please note even when you withdraw consent or exercise your right erase your Personal data, we may not be able to provide you some or all of our services, depending on the nature of data requested for erasure.

We may retain your Personal Data after account closure if it is reasonably necessary to comply with our legal obligations, meet regulatory requirements, enforce our legal rights or defend ourselves in a claim, resolve disputes, maintain security, prevent fraud and abuse, enforce our User Agreement, or fulfil your request to “unsubscribe” from further messages from us. De-personalized data will be retained even after your account has been closed.

You may opt out of receiving information about promotional offers by writing to our grievance officer. We may still need to send you non-promotional communication (information about the Platforms and services).
   4. You may have certain additional rights regarding your personal information based on your local laws. This could include the right to:
      1. Ask us for a summary of your Personal Data;
      2. Ask that we amend or update your personal data if it is inaccurate or outdated;
      3. Withdraw consent if our Processing of your Personal Data was based on your consent. If you withdraw consent, we may not be able to provide products and services to you;
      4. Request deletion of your data. However, we may not be able to delete your data and retain it for reasons provided under Clause 5 above.

Please note that Force Majeure events encompass occurrences beyond inCars' reasonable control, including but not limited to acts of sabotage, fire, flood, explosion, natural disasters, civil unrest, labor strikes, riots, insurrection, war, governmental actions, computer breaches, unauthorized network access, system failures, security breaches, and encryption-related events.

As these third-party operations lie outside our realm of control, inCars refrains from providing endorsements, guarantees, or representations regarding the services or products available on these third-party websites. Similarly, we do not assume responsibility for the privacy policies or any other policies maintained by these third-party sites.
   3. The decision to engage with third-party websites or make use of the services and products they offer is entirely at your discretion, and inCars shall not be held responsible for any potential loss or damage that may result. We strongly advise exercising due diligence by reviewing the privacy policies of such third-party websites before you choose to interact with them.

    1. Our Services, are not directed at individuals below the age of 18 years (“Minors”). Minors are not permitted to sign up by themselves to the Services. We do not knowingly collect or solicit Personal Data from Minors.
    2. In the event that we learn that we have collected Personal Data from a Minor without verification of parental consent where this is required, we will delete that Personal Data as quickly as possible.

    2. Please note that inCars’s Grievance redressal mechanism addresses only the issues related to the manner in which we process and manage your data on our Platform and in no way, can address any other issues that you may have with inCars.

We further inform you that as per the Digital Personal Data Protection Act, 2023, if you have any concerns with respect to the manner in which we Process your Personal Data, you may also make a complaint to the Data Protection Board as and when established through a notification by the Central Government and in a manner as prescribed after going through the grievance redressal mechanism provided above.
